Eyemesto Shipping Terms of Service

1. Acceptance of Terms

These Terms of Service constitute a legally binding contract between you and 16847323 CANADA LIMITED operating as Eyemesto Shipping ("Eyemesto Shipping"). By creating an account, clicking "I Accept the Terms of Service," or using the platform, website, or any services provided, you acknowledge that you have read, understood, and agreed to be bound by these Terms, together with the Privacy Policy and other policies incorporated by reference.

2. Services and Role of Eyemesto Shipping

Eyemesto Shipping provides a technology-enabled platform for rate comparison, label generation, booking of shipments with third-party carriers, customs documentation assistance, and related logistics tools. Eyemesto Shipping does not itself transport or physically handle shipments; all transportation services are performed by independent third-party carriers whose terms and conditions also apply.

3. User Responsibilities

By using the services, you agree to provide accurate and complete information, comply with all applicable laws and carrier terms, refrain from shipping prohibited items, ensure proper packaging and labeling of shipments, and obtain appropriate insurance where necessary. You remain responsible for all charges incurred through your account, including any remeasurement or accessorial charges applied by carriers.

4. Rates, Extra Charges, and Payment

Rates displayed on the platform are estimates based on the information you provide and may be adjusted if carrier-assessed weight, dimensions, or surcharges differ from your inputs. You authorize Eyemesto Shipping and its payment partners to charge your selected payment method for all orders, extra charges, remeasurement charges, and related fees in accordance with the Terms of Payment.

5. Limitation of Liability and Indemnity

To the maximum extent permitted by law, Eyemesto Shipping disclaims liability for loss, damage, delay, or non-delivery of shipments and for indirect, incidental, or consequential damages. Your sole remedies in relation to lost or damaged shipments are as set out in the applicable carrier terms and claims process. You agree to indemnify and hold Eyemesto Shipping harmless from claims arising from your use of the services, your inputs, the contents of your shipments, or your breach of these Terms.

6. Suspension and Termination

Eyemesto Shipping may suspend or terminate your account, with or without notice, if you violate these Terms, fail to make timely payments, provide inaccurate information, or otherwise misuse the platform. Suspension or termination does not relieve you of outstanding payment obligations, and no refunds will be issued where termination is for cause.

7. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which Eyemesto Shipping is incorporated, without regard to conflict of law rules. Disputes will first be subject to good-faith negotiation and, failing resolution, addressed in accordance with the Dispute Resolution & Arbitration Policy.
