1. User Indemnification

By using the Eyemesto Shipping platform, you agree to defend, indemnify, and hold harmless 16847323 CANADA LIMITED operating as Eyemesto Shipping ("Eyemesto Shipping"), its officers, directors, employees, contractors, agents, and partners from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use or misuse of the Eyemesto Shipping platform.
• Your violation of these policies or any applicable law or regulation.
• Your shipment of prohibited or restricted items.
• Any inaccurate or incomplete information you provided during account registration or booking.
• Any claims brought by third parties (including carriers, customs authorities, or recipients) arising from your shipments.
• Your infringement of the intellectual property or rights of any third party.

2. Disclaimer of Warranties

THE EYEMESTO SHIPPING PLATFORM AND ALL RELATED SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. EYEMESTO SHIPPING MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Eyemesto Shipping does not warrant that the platform will be uninterrupted, error-free, or free from viruses or other harmful components. Shipping rates, transit times, and carrier availability are provided as estimates and are not guaranteed.

3. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EYEMESTO SHIPPING'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE FEES PAID BY YOU TO EYEMESTO SHIPPING IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

IN NO EVENT SHALL EYEMESTO SHIPPING BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL.

4. Third-Party Services

Eyemesto Shipping is not responsible for the acts, errors, omissions, representations, warranties, or conduct of any third-party carrier, insurance provider, or other service provider accessed through the platform.

5. Governing Law

This Indemnification and Disclaimer is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in accordance with the Dispute Resolution & Arbitration Policy.
